Legal Method and Case Management

The course provides an introduction to legal methodology and general administrative law. The teaching is based on the application of law that professional practitioners use. When learning the legal method, emphasis is placed on the legal text as the primary source of law, in addition to draft laws, case law and other sources of law.

In the second part of the subject, an introduction to general administrative law will be given. The basis for proper case management in the administration is knowledge of the General Administration Act's case management rules.

When reviewing the legal method and the rules of the Public Administration A>ct, practical examples form the area of welfare law are taken as a starting point.

Themes that are emphasized in general administrative law are legal certainty, including impartiality, contradiction, confidentiality, party acces, disclosure of the case, decision, justification, notification, right of appeal, invalidity and the use of conditions.

Knowledge - The student has:

• knowledge of legal methodology and how to approach legal questions relevant to social workers and child welfare educators.
• knowledge of general administrative law, including the Administrative Procedures Act and fundamental administrative principles.

Skills - The student can:

• identify the requirements for the legal basis of administrative decisions made by social workers and child welfare educators
• identify and address legal issues based on legal methodology

General competences - The student can:

• communicate legal questions and relate them to professional issues.
• work with legal questions related to the professions of social work and child welfare education.

Learning activities consist of lectures and seminars. Part of the teaching may be done in English.
